3 Questions to Ask Before Using AI for Your Estate Plan

Artificial intelligence is changing everything, including how people are approaching estate planning. There are now AI-powered tools that promise to generate a will, a trust, or a power of attorney in minutes, for a fraction of the cost of working with an attorney.

I am not here to tell you technology is bad. I am here to ask you three honest questions before you trust your loved ones’s future to an algorithm.

Question 1: Does the AI Know Your State’s Laws?

Estate planning is deeply state-specific. Colorado has its own rules about probate, trust administration, powers of attorney, healthcare directives, and how assets pass between spouses and partners. An AI tool built on general legal principles may not reflect the specific requirements of Colorado law, and a document that does not meet those requirements may not hold up in court.

Beyond state law, your personal circumstances matter enormously. Whether you own property in multiple states, have a blended family, run a business, or have a child with special needs, each of these factors requires specific, tailored legal strategy that a generic tool simply cannot provide.

Question 2: What Happens When the AI Gets It Wrong?

AI tools make mistakes. They may generate documents with contradictions, missing provisions, or language that does not align with your actual wishes. The problem is that you probably will not know a mistake was made, until your loved ones are dealing with the fallout.

An estate planning attorney carries professional liability, meaning they are accountable for the quality of their work. An AI tool is not.

This is really the heart of the question. Yes, AI tools are cheaper than working with an attorney. But the costs of a failed estate plan (probate fees, legal disputes, assets in the wrong hands, conflict among loved ones) can dwarf the upfront savings.

More importantly, estate planning is not just about the documents. It is about having a trusted advisor who knows your story, asks the right questions, and creates a plan that truly reflects your life and your wishes. That relationship has value that no algorithm can replicate.

To be fair, AI tools can be useful for education, helping you understand what estate planning involves and what questions to ask.
